Business Interruption Claims

TrialView was the platform of choice to conduct a digital hearing involving 6 parties and 4 separate law firms over 8 weeks in the Dublin Commercial Court. The claims involved significant business interruption claims against FBD Insurance.

The hearing was conducted during the heightened restrictions arising from the Covid 19 pandemic, requiring the use of TrialView’s integrated video conferencing tool to allow for the numbers in Court to be reduced.  Witnesses gave evidence remotely with the facility for clients to follow the proceedings and see the evidence online. With thousands of documents, the parties were allowed to run a fully digital trial.

After the hearing, Barry Cahir, senior partner for Beauchamps stated “… I can attest fully to the high functionality of TrialView” in what he described as “very testing conditions”. 

Judicial Praise

The parties also used TrialView’s evidence presentation features, which proved vital for the parties in getting through the voluminous evidence quickly.  At the conclusion of the liability hearing, Mr Justice McDonald thanked TrialView “for the exceptional way it managed to bring up every single document, no matter how many documents were referred to by counsel.”

Speaking after the trial, Gavin Simons of Amoss Solicitors commented that due to Covid restrictions the case could not have proceeded without TrialView and it “worked without a hitch”.
